The fan funding feature (“Fan Subscriptions”) allows Facebook users (“Fans”) to support their favorite Pages, creators, gamers, or others (“you,” “your,” or “Creators”) through a subscription with Facebook that provides access to digital content offered by Creators (“Subscription”). These Fan Subscription Creator Terms (“Terms”) govern how Creators use Fan Subscriptions. Your use of the Platform with respect to Fan Subscriptions is subject to, and you agree to comply with, the Platform Policy and the Facebook Commercial Terms.
Your use of Fan Subscriptions to offer digital content and/or services to Fans is subject to, and you agree to comply with, the (a) Partner Monetization Policies, and (b) Content Monetization Policies. You agree to follow any additional instructions and/or technical documentation we provide to you for Fan Subscriptions.
When Fans subscribe to your content, you may receive or download an e-mail address and other data associated with the Fan and their use of Fan Subscriptions. You agree that you will not use this data for any purpose other than to communicate with Fans about the content you provide and that you will not use the email address or any data associated with the Fan that you receive in connection with the Fan Subscription after their Fan Subscription has ended, unless you first obtain their permission to do so, consistent with applicable law.
You will provide accurate information to Fans in connection with your use of Fan Subscriptions, including but not limited to any digital content or services you choose to offer to them. You must clearly and conspicuously disclose all material terms regarding your offer and the nature of content or services you will provide to Fans once they choose to subscribe, including the length of the Subscription term.
You agree to comply with all laws applicable to your use of Fan Subscriptions.
You confirm that the content you offer via Subscription does not infringe upon the intellectual property rights of any third party and that you have secured all rights necessary to distribute, copy, display, publicly perform, or otherwise use the content. You further agree not to use or incorporate any music in connection with your use of Fan Subscriptions unless the music is licensed through Meta’s Sound Collection, you own and/or control all rights in all music included in the content (i.e., you wrote, performed, and recorded all music and lyrics yourself, or you have obtained and paid for licenses from all relevant record companies, music publishers, and other rightsholders to feature the music in your content in all countries where your content is made available), or the music is in the public domain. Any reports of unauthorized use of music or other intellectual property rights may result, among other things, in your content being blocked and/or your use of Fan Subscriptions being terminated under section 15.
You will not use, incorporate, or provide physical goods in connection with your use of Fan Subscriptions.
You may not promote or facilitate any gambling, including, for example, a lottery or a raffle, using Fan Subscriptions. If you communicate or administer a promotion, for example, a contest or sweepstakes, using Fan Subscriptions, you confirm and agree that you are responsible for the lawful operation of that promotion, including with respect to the promotion’s official rules, eligibility restrictions, and compliance with any applicable law or regulation governing the promotion and awarding of prizes (for example, any requirements relating to registration or regulatory approvals). Meta will not assist you in the administration of your promotion, and you confirm and agree that if you use Fan Subscriptions to communicate or administer your promotion, you do so at your own risk. Any such promotion must include a complete release of Meta by each entrant or participant and an acknowledgement that the promotion is in no way sponsored, endorsed, administered by or associated with Meta. For the avoidance of doubt, any such promotion may not award as a prize, or otherwise involve, physical goods.
Meta will pay you a revenue share calculated as a percentage (“Your Share”) of what’s left of the revenues from your Fan Subscriptions after deduction of fees/charges and of any other fees or taxes incurred by Meta. Your Fan Subscriptions may be processed as payments to Meta via
Apple’s or Google’s In-App Purchase services, which are subject to
Apple’s or Google’s separate payment terms and conditions, respectively.
Apple and other platforms may charge Meta a revenue share and/or other fees for such payment processing services according to their terms and conditions. Meta may deduct for itself a revenue share of up to 30% of your Fan Subscriptions that begin on or after January 1, 2020; notwithstanding the foregoing, this does not apply to renewal of Fan Subscriptions that began before January 1, 2020. However, Meta will first deduct revenue shares, fees, and charges by
Apple, Google, or other platforms from Meta’s own revenue share. For example, if Meta's revenue share is 30% of the gross revenue from your Fan Subscriptions that begin on or after January 1, 2020, and the revenue shares, fees, and charges by other platforms are 15%, then Meta’s revenue share would be 15% and Your Share would be 70%. A Fan Subscription will be deemed to begin on or after January 1, 2020, if it is not an initial term or automatic renewal of a Fan Subscription that began before January 1, 2020. Meta may in the future change the revenue share provisions contained in these Terms. Meta will give 30 days' notice of any such change.
Completion of the payment enrollment process within six months after you accept these Terms is a condition of payment. If you do not complete the payment enrollment process within six months after accepting these Terms, you forfeit and waive all rights to receive payment of any funds collected through Fan Subscriptions.
Meta may disable automatic renewals of some or all Fan Subscriptions in Meta’s sole discretion.
Meta reserves the right to offer discounted Subscriptions and free trials for Fans in its discretion from time to time for any reason. In such instances, Your Share will be reduced accordingly, and Your Share will be based on the amounts Fans actually pay (less fees and taxes incurred by Meta).
Payment to you of any net amounts Meta receives for Subscriptions from Fans will be made on a monthly basis, within 60 days after the end of the applicable month, subject to the accurate completion and timely provision of all forms and documentation that Meta reasonably determines is required to complete such payment, and subject to your compliance with these Terms. Meta will not be responsible for any subsequent fees applied by your financial institution to complete payment of the monthly fee to you. Furthermore, in the event the payment due to you would be less than (a) Twenty-Five U.S. Dollars ($25.00) if you reside in the United States, or (b) One Hundred U.S. Dollars ($100.00) if you reside outside of the United States, Meta reserves the right to roll such payment over month to month until such payment threshold is met (unless your account is deactivated or terminated, in which case you forfeit any accrued amounts), at which time Meta will make the applicable payment to you. Meta also reserves the right to set off and/or withhold any amounts that Meta reasonably considers is due or is likely to be payable by you to Meta under these Terms (including under any indemnities).
If you provide (or allow Meta to access) any data, content, or other information in connection with your use of Fan Subscriptions (collectively, “Supplemental Data”), then you grant Meta (and its affiliates) a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use such Supplemental Data. This license survives even if you stop using Fan Subscriptions. You are responsible for obtaining the necessary rights from all applicable rights holders to grant this license.
You are responsible for paying any applicable taxes owed with respect to any amounts you receive through your use of Fan Subscriptions. Meta will charge you taxes with respect to such amounts if it is required to do so under applicable law.
Meta can terminate or suspend your use of Fan Subscriptions at any time in its sole discretion, and may change or stop offering Fan Subscriptions at any time in its sole discretion. In no event will Meta be liable for terminating or suspending your use of Fan Subscriptions, for the discontinuation of Fan Subscriptions, for the removal of or disabling of access to content, or for the withdrawal of the content or Fan Subscriptions.
If you change what's included in a Subscription in a way that could be considered material, you must give Fans reasonable prior notice such that they have a reasonable opportunity to cancel their Subscriptions if they so choose, with the change only taking effect after their next Subscription fee payment is due.
If you are using Fan Subscriptions on behalf of a third party (including, but not limited to, as an agent or representative of a Creator), you represent and warrant that you have the authority as agent of such party to use such features on their behalf, agree to these Terms, and hereby bind such party to these Terms. You agree to indemnify and hold Meta harmless from any claims, suits, losses, liabilities, damages, costs, and expenses resulting from your breach of the Terms. If you are accepting these Terms as admin or Meta Business Manager for your business, these Terms shall apply to content on all Facebook Pages and profiles owned or operated by your business at the time of acceptance and thereafter.
You agree to receive electronic communications regarding your use of Fan Subscriptions, Your Share, payments, and other related topics. You also agree to receipt of such communications through Meta posts, via the e-mail address provided to us, or by mail at the street address that you provided to us. Website and e-mail notices shall be deemed received by you within 24 hours of the time posted or sent; notices by mail shall be considered received within 3 business days of the date sent.
Meta reserves the right to update these Terms from time to time. If any change to these Terms are material, we will provide you with notice before the changes become effective, so that you can choose to terminate or discontinue your use of Fan Subscriptions. Your continued use of Fan Subscriptions despite material changes to the Terms constitutes acceptance of such changes.
Fan Subscriptions is part of the “Meta Products” under Meta's Terms of Service (“Facebook Terms”), and your use of Fan Subscriptions is deemed part of your use of Meta Products. In the event of any express conflict between these Terms and the Facebook Terms, these Terms will govern solely with respect to your use of Fan Subscriptions and solely to the extent of the conflict. These Terms do not alter in any way the terms or conditions of any other agreement you may have with Meta. Meta reserves the right to monitor or audit your compliance with these Terms and to update these terms from time to time.
