To answer the question: "If I register my electric car in an Illinois LLC and the registered LLC falls into the "Low Income Certification Level" per the Illinois Electric Vehicle Rebate Program Application Form, can I still claim the $4,000 rebate credit?"

This question is raised since majority of EV owners seems to fall out of the Low Income Certification Level according to the Illinois rebate form below:

According to the EPA.EV <EPA.EV@Illinois.gov> per email:

The Electric Vehicle Rebate Program is for individuals, not governments, businesses or commercial entities.


Thus, you can only claim the credit as an individual, and NOT an LLC or business entity.


Section 5: Low-Income Certification
The Electric Vehicle Rebate regulations define “low income” as persons and families whose income does not exceed
80% of the State median income for the State fiscal year (July 1, 2021 - June 30, 2022), as established by the U.S.
Department of Health and Human Services. The regulations further provide that to qualify as "low income," the total
combined gross income of the applicant and all persons over the age of 18 living at applicant’s residence and related to
applicant by blood, marriage, or adoption cannot exceed 80% of the State median income.

The applicant’s household count is to be determined by totaling the applicant and any individual or group of individuals
living with the applicant as one economic unit, which may include persons under the age of 18 and persons unrelated to
applicant by blood, marriage, or adoption.

The applicant’s income level is to be determined by totaling the combined gross income of the applicant and all persons
over the age of 18 living at applicant’s residence and related to applicant by blood, marriage, or adoption.
After determining the applicant’s household count and income level as previously noted, find the appropriate calculated
household count in the table below. If the applicant’s calculated gross income level is at or below the corresponding
income level threshold, the applicant is considered low income. For example, an applicant whose household count is 3
must have an income level at or below the income level threshold of $68,656 to be considered low income.



Illinois' Electric Vehicle Rebate Program begins July 1, 2022. Illinois residents that purchase a new or used all-electric vehicle from an Illinois licensed dealer will be eligible for a rebate in the amounts set forth below.

A $4,000 rebate for the purchase of an all-electric vehicle that is not an electric motorcycle.
A $1,500 rebate for the purchase of an all-electric motorcycle.
Purchasers must apply for the rebate during an open rebate cycle and within 90-days of vehicle purchase. Application forms will be available on this webpage during open rebate cycles.

Eligibility requirements for an EV rebate in Illinois include, but are not limited to:

The purchaser must reside in Illinois at time of vehicle purchase and at the time the rebate is issued.

The vehicle must be purchased from a dealer licensed by the Illinois Secretary of State.

Rented or leased vehicles do not qualify for the rebate.

The vehicle cannot have been the subject of a previous EV rebate under this new program in Illinois.

The rebate amount cannot exceed the purchase price of the vehicle.

The purchaser must retain ownership of the vehicle for a minimum of 12 consecutive months immediately after the vehicle purchase date.

The purchaser must apply for the rebate within 90-days after the vehicle purchase date.

Documentation requirements include a copy of purchase invoice, proof of purchase, vehicle registration, and IRS W-9 or W-8 forms.
